A man who broke into an apartment and pointed a gun at the tenant's 12-year-old grandson, then shot the tenant in the groin, has been arrested and charged.

29-year-old Danial Lowe, of Jefferson City, was arrested for an incident at an apartment on Evergreen Drive in Holts Summit on Aug. 3, 2018.

According to a probable cause document, a man, later identified as Danial Lowe, knocked on the door of an apartment and the tenant's 12-year-old grandson unlocked the door. Lowe then pushed past the grandson.

The tenant said he was in the bathtub and came out to see who was speaking with his grandson. This is when he saw Lowe pointing a gun at his grandson.

The probable cause document stated Lowe started to raise the gun toward the tenant who grabbed Lowe's gun and a fight ensued.

Lowe shot the tenant in the "groin area" and then the tenant was able to wrestle the gun away from the suspect, the document said. Then Lowe ran from the apartment.

It wasn't until March 15, 2020, that the tenant said he heard "word on the street" that Danial Lowe was the person who shot him in August of 2018.

The documents stated law enforcement presented a photo lineup to the tenant who "immediately pointed to the photo of Lowe as the one who shot him."

Officers then took the photo lineup to the tenant's 12-year-old grandson who also pointed out Lowe and "stated he was absolutely positive" Lowe was the one who shot his grandfather.

On May 7, Callaway County Sheriff’s Office deputies arrested Lowe and he was charged on the same day for the felony offenses of first-degree assault, first-degree burglary, and armed criminal action.

Law enforcement said the investigation is ongoing and further arrests or charges are possible.
