Nevada lawmakers are debating a bill on pre-employment drug test for marijuana

D-Assemblywoman Dina Neal, sponsored a bill that would prevent employers from refusing to hire someone for testing positive for marijuana during a pre-employment drug test.

The bill would also prohibit an employer from using a character assessment during the hiring process.

Cris Novich, Managing Director at Fulltilt Logistics says, "We do pre-employment screenings through the Department of Transportation and they test for marijuana so it comes back positive for marijuana then we can't hire them legally."

Novich explained that it if this bill is passed, it would be up to both the U.S. Department of Transportation and the insurance company on whether or not this would affect them.

News 4 - Fox 11 spoke to Warren B Hardy II, a lobbyist with the Nevada Restaurant Association who says, "Where the liability resides. If you’re the one who’s going to be liable if there’s an accident that happens because of one of your employees is injured because of an impairment situation then the owner is going to be responsible for that."

Hardy mentions he is worried about the "character assessment" section of the bill. He says, "it needs to be tightened up so its clear when we're talking about someones character or personality."

Neal made it clear that this bill does not encourage people to be high or impaired with marijuana at work.
