Lemonade stands not specifically legal in Montana

You might want to think twice about having a lemonade stand this summer, in 35 states you're not allowed to have one without a permit and Montana is one of them.

Country Time Lemonade says only 15 states allow people to have a lemonade stand without a permit.

Colorado and Texas are some of the the most recent additions.

"Typically, if it's something in the neighborhood, something occasional, then there's nothing that would trigger any permit or licensing requirements in Missoula," said Development services director for Missoula Mike Haynes.

Without a permit though in other counties you may face a fine and you may be shut down. If that happens the lemonade company will cover any fees that lemonade stand owners may face for not having a permit.

The company is telling parents and kids to reach out to state representatives to get your laws changed.

Country Time Lemonade created a website http://countrytimelegalade.com/ and here they encourage people to download yard signs to rally for the cause.

Mike Haynes has advice for kids this summer, "get out there and have fun."

If it is not your full-time business, you won’t face a fine.
