A criminal complaint has been filed against a 46-year-old man accused of driving under the influence at the time of a deadly crash in North Las Vegas last month.

Clark County District Attorney Steve Wolfson said in a statement Friday the complaint charges Anthony Peniston with felony counts of DUI resulting in death and reckless driving.

Peniston is accused of driving at an excessive speed and failing to stop at a posted stop sign before hitting another car.

The driver of the other car, identified as 73-year-old Arthur Hobbs, was pronounced dead at the scene.

"Peniston’s blood alcohol level was such that my office determined the felony charges of Driving Under the Influence Resulting in Death and Reckless Driving were warranted," Wolfson said.

Court records indicate a hearing was held on Nov. 21 but no complaint had been filed, with prosecutors requesting 45 days and Peniston being released.

A complaint was then filed on Thursday, Dec. 12, with a hearing for motions scheduled on Thursday, Dec. 19, in North Las Vegas Justice Court.

An attorney for Peniston could not be immediately reached for comment.
