Teen indicted in Birmingham shooting that killed unborn baby

A Birmingham teen has been indicted in a shooting that led to the death of the pregnant victim's unborn child.

Avery Robert Turner, 19, was indicted by a Jefferson County grand jury on the charge of capital murder. He's been in jail - held without bond - since the April shooting.

It happened about 8 p.m. that Friday at 916 First Street North in the city's Smithfield community. Police initially said a pregnant female was shot in the leg and taken to UAB Hospital by Birmingham Fire and Rescue. However, authorities later said the victim was actually shot in the abdomen and the baby did not survive the injury.

Authorities identified the unborn child only as Baby Davis. The unborn baby was taken to the Jefferson County Coroner's Office where an autopsy was performed on Monday. Police later said coroner's officials deemed the unborn baby died as a direct result of the injuries obtained by the mother in the shooting.

Authorities said Avery was not the father of the unborn child and said he did not have any relationship with the pregnant female. The woman was, however, targeted in the shooting but the reason for that wasn't immediately clear.

A trial date has not yet been set.
