Arizona Legislators Reject Marijuana Edibles Bill

On March 21, a proposal to clarify that marijuana-infused edibles are legal for medicinal use in Arizona was rejected by Republican lawmakers.

On a 29-29 vote, the Arizona House denied Rep. Randall Friese’s proposal, Tucson.com reported. Friese was hoping to explicitly add the word “edible” to Arizona’s medical marijuana law.

Yavapai County authorities continue to arrest medical marijuana patients for the possession of marijuana extracts, which are oftentimes used to make edibles. Rep. Pamela Powers Hannley understands that legislative action is needed to definitively clarify the legality of marijuana extracts in Arizona.

“People are buying these marijuana derivatives, the concentrates and the edibles legally, and paying taxes, but in certain counties in Arizona they’re being arrested for these things that they bought legally,” said Hannley.

Friese’s proposal may have been rejected, but on March 19 the Arizona Supreme Court discussed the legality of medical marijuana extracts in Arizona, and the justices appeared to agree that medical marijuana extracts are included in the Arizona Medical Marijuana Act (AMMA), which would make them legal in Arizona.

Until the Court rules on this issue (which is expected to be in a few months), most Arizona dispensaries will likely continue to sell extracts to qualifying patients.
