Mumbai: Man gets bail in driver’s assault and death case

Justice Prakash D Naik said: “Statements of the witnesses indicate there was a mob and few people know the applicant (Devendra). In any case, from the documents on record, it cannot be assumed that there was any intention to commit murder.”

The Bombay High Court recently granted bail to a man, who allegedly chased a truck driver and beat him to death on the road. The deceased was allegedly driving close to his friend’s wife and had also allegedly harassed her.

According to police, on April 16, 2018 they got a call from one Santosh Sutar, who informed them that a container truck driver was assaulted by people and he had intervened and rescued him.

During investigation, it was revealed that the driver of the truck was driving very close to the woman, who was riding a motorcycle. The driver chased the woman, passed some lewd comments and tried to harass her. He was assaulted. Three accused, Kiran Bhoir, Jayesh Patil, who is the husband of the woman who was allegedly harassed by the driver, and Devendra Patil, were identified and arrested.

They all were residents of Sapne village at Wada in Palghar. Devendra had approached the High Court for bail. His lawyer told the court that he had been falsely implicated, as he was not even present at the scene of offence. The lawyer said the driver was intercepted by a mob and allegedly assaulted, leading to his death. There was no intention to commit murder, he said. The prosecution told the court that Devendra was present at the spot and the driver was assaulted by several people, including Devendra, causing severe injuries.
