FARGO (KFGO) – An attorney for the city of Fargo is denying allegations that a former firefighter made in a federal discrimination lawsuit. Scot Kelsh claims he was a “protected person” when he was terminated by the Fargo Fire Dept. in 2016.
Defense attorney Howard Swanson says in court documents that the city wants the complaint to be dismissed. Swanson says the city assisted Kelsh in trying to find other employment, but Kelsh wasn’t qualified or eligible.
Kelsh has also alleged that after he was diagnosed with work-related post traumatic stress disorder, the city illegally disclosed confidential medical information.
The city maintains that Kelsh voluntarily disclosed the information and explicitly identified his disability to the Fargo Civil Service Commission.
Kelsh is suing the city for $1.8 million. Swanson is asking a judge to dismiss the case and to award the city associated costs and attorney fees.
