FARGO (KFGO) – Charges have been filed in connection with a crash in south Fargo that killed a 7-year-old boy and seriously injured his 5-year-old brother.
Cass County States Attorney Birch Burdick charged 31 year-old Christopher Devine with one count of criminal vehicular homicide and two counts of criminal vehicular injury. The crash happened Saturday night in the 1300-block of South University Drive.
Court documents say Devine’s vehicle was traveling 74 mph four seconds prior to the crash. The vehicle was traveling 59 mph one second before the crash.
Devine’s blood-alcohol level was .267. Devine told police that he had been drinking whiskey and has no memory of the crash.
Seven-year-old Jason Devine died Tuesday morning. His 5-year-old brother Branden remains in critical condition.
A front-seat passenger in Devine’s car was also injured. Three people in the second vehicle were not injured.
