Take over Dehradun private medical college in 24 hours: Supreme Court to government

DEHRADUN: In a first of its kind order, the Supreme Court asked the Uttarakhand government on Thursday to take over the land, building and assets of privately owned Shridev Suman Subharti Medical College within 24 hours and run it as a government medical college. The order was passed after a writ petition was filed by 74 medical students (all NEET pass-outs) who complained that Subharti Trust had defaulted in its responsibilities including obtaining necessary affiliation and permissions from the Medical Council of India.
Legal experts said that this was the first time that the apex court had asked a state government to take over a private college.
Talking to TOI, deputy advocate general of Uttarakhand, Jatinder Kumar Sethi, said that the medical college, which has until now admitted two batches of MBBS students, had obtained a no-objection certificate (NOC) from Garhwal University but had still not received an affiliation. “The medical college tried to get affiliation from Subharti University which left the students unhappy. They were under the impression that the institute would be affiliated to a central university. They also alleged that the infrastructure and facilities in the institution were not up to the mark.”
The advocate further stated that the Medical Council Of India also inspected the institute last year and found many shortcomings. The MCI in 2017 had denied permission to the institute to admit students in the next academic session. The MCI allowed 150 students, who took admission in the college in 2016, to continue with their studies.
Sethi said, “The apex court asked us if the Uttarakhand government can do anything to help the students or adjust them in the other three government medical colleges in the state. I told the court that it is not possible as all the existing colleges are full and we have to create new infrastructure to accommodate these students. The court then ordered the Uttarakhand government to take over the SSSMC immediately.” Sethi added that the order was unprecedented.
The court said that the college must hand over land, building and all assets to the Uttarakhand government by December 7.
Once the state government sets up the necessary infrastructure, it has to apply for affiliation from MCI under section 10A of MCI Act. The court has also directed DGP Dehradunt o seal the SSSMC campus with immediate effect. Principal, SSSMC, Rajesh Mishra said that he was yet to receive a copy of the order.
