PATNA: The Patna high court on Friday directed the state government to bring on record the details of recruitment of retired DSPs in vigilance department through contract along with the process followed.
A division bench of Chief Justice Amreshwar Pratap Sahi and Justice Anjana Mishra gave four weeks’ time to submit a counter affidavit while hearing the PIL filed by one Sanjay Kumar.
The petitioner had written a letter to the CJ alleging embezzlement of Rs30 lakh earmarked for repair of an old temple at Khaira in Jamui and no action taken by the vigilance investigation bureau in the case lodged by it.
Citing financial strain to hire a lawyer, Kumar had urged CJ to turn his letter into a PIL. It was on Kumar’s complaint that the vigilance bureau had lodged a case against nine persons alleging financial irregularities in October 2016. The case was initially being investigated by Shiv Chandra Singh, a retired DSP who was appointed on contract in the bureau. Later, it was handed over to another retired DSP Akshay Mishra. The bureau had cited change in investigating officer as the reason behind delay in completion of the investigation when HC asked how state had made contractual appointments for investigation.
Advocate general Lalit Kishore submitted a counter affidavit on Friday with details of the rules through which the contractual recruitments of ASPs and DSPs were made in the bureau and special vigilance unit. Kishore also apprised the court that the department had sent requisition to Bihar Public Service Commission for hiring of regular officers, but the commission could not do it and contractual appointments were made.
However, the court was not satisfied and directed the government to bring on record all the details of contractual recruitment made till now along with the state government’s rules for it.
