A Truro man who is considered to be a danger to the public because of his violent behaviour must remain in hospital indefinitely.

James Farnon Nolan, of Albany Road in Truro , was convicted at Truro Crown Court on Thursday (November 22) for being in possession of an axe type weapon on the streets of the city.

The 28-year-old was carrying a hatchet on Princes Street on April 10.

Farnon Nolan was sentenced by Judge Simon Carr on Friday.

The court heard from a doctor, who confirmed that Farnon Nolan has “significant mental health problems” and is a risk to others.

Judge Carr handed Farnon Nolan, who did not attend the hearing, a restricted hospital order under Section 37 of the Mental Health Act, which means he will remain in hospital instead of prison.

Judge Carr also added a restriction order under Section 41, meaning he cannot be discharged from hospital until he is deemed well enough for release.

“I’ve read a significant number of reports and the defendant has a significant psychiatric history," Judge Carr said.

“He is proving even within the environment he presently is in, significantly difficult. He doesn’t accept the level of his illness or need for medication.

“Sadly, he has exhibited high levels of violence on those responsible for his care.

“His treatment will continue in the secure unit he presently resides in. An additional restriction order will be made under Section 41, which is necessary to protect the public.”
