Homeowner shoots home invader who undressed to his underwear, Louisville police say

The man shot Sunday morning after police say he broke into a Taylor Berry home had stripped down to his underwear and refused to leave.

Donald Oliver, 38, is charged with first-degree burglary, fourth-degree assault and heroin possession.

He's accused of entering the home in the 1200 block of Homeview Drive about 7 a.m. through a window.

Oliver went into an 11-year-old girl's bedroom, undressed and then went into the kitchen in only his underwear, according to an arrest slip.

A male homeowner demanded Oliver leave and got into a physical fight with him, injuring his hand, police said. 

He yelled to his girlfriend for help. She fetched a gun from the bedroom which he then used to shoot Oliver multiple times.

Oliver was taken to the University of Louisville Hospital on Sunday morning before being booked later in the day into Metro Corrections. 

The homeowner is not expected to be charged.

Oliver, who court records show lives one block away from the home, pleaded not guilty Monday in Jefferson District Court. He remains in jail in lieu of a $50,000 cash bond.
