FRRO tells 59 Chinese workers to leave India

The company – which undertakes design, development and assembly of mobile phones – says the Chinese nationals provide technical know-how and expertise to the local workforce.

Fifty nine Chinese professionals have been issued 'Leave India' notices by the Foreigners Registration Officer for misusing their visas. All of them work with Pacific Cyber Technology Private Limited in Dadra and Nagar Haveli, and the firm moved the Bombay High Court on Wednesday, challenging the petition.

The company – which undertakes design, development and assembly of mobile phones – says the Chinese nationals provide technical know-how and expertise to the local workforce.

Advocate Nausher Kohli mentioned the petition filed by Pacific Cyber Technology Pvt Ltd before a bench of Justices B P Dharmadhikari and Sarang Kotwal. The bench posted the matter for further hearing on Friday.

"The company has manufacturing units in Daman and Silvasa," said Kohli, "The notices have been issued to customer representatives, supplier representatives, and representatives of the Hong Kong Entities who were visiting the plants to provide technical guidance to employees." The petition states that the notices direct the Chinese representatives to leave India immediately for misuse of their business visas, which is arbitrary and ex-facie illegal, as there is no such violation.

The firm argues that the contribution of these foreign nationals benefits the revenue of the country as the company is committed to the government's vision to 'Make in India'. "Thus, it is imperative to stay the effect, operation and implementation of the notices urging the nationals to leave the country," Kohli argued. The petition prays for direction to restrain authorities from taking any coercive steps against the Chinese professionals.

Kohli that authorities visited the firm's manufacturing plant on December 4, and began asking about the foreigners. They even photographed them and took videos. "So far, six nationals have left India, and 53 of them are still in the country," said Kohli.

The plea prays for a stay the notices and after calling for records and documents, to set aside the notice.
