August 24, 2019 - SACRAMENTO – California Attorney General Xavier Becerra on Friday issued the following statement after the U.S. Court of Appeals for the District of Columbia Circuit xavier becerra california attorney general(D.C. Circuit) issued a ruling upholding the U.S. Environmental Protection Agency’s (EPA) revised air quality standards for ozone — more commonly known as smog—against challenges from corporate interests and other states. The standards, set in 2015, strengthened previous ozone standards that EPA had determined did not adequately protect human health or the environment. Attorney General Becerra and the California Air Resources Board led a coalition of seven states and state air agencies and the District of Columbia that stepped up to defend the rule alongside the EPA in Murray Energy Corporation v. EPA.

“Today’s decision strikes down an attempt by corporate interests to weaken ozone standards and continue to collect massive profits at the expense of our children’s health,” said Attorney General Becerra. “For many, poor air quality is not just upsetting, but debilitating. It means missed days of school, work, and countless other opportunities. It’s a matter of life and death. Our children should never be left gasping for air because of government inaction or corporate greed. We applaud today’s ruling, which we hope will help families breathe a little easier.”

Ozone is the primary component of urban smog and causes various health problems, particularly in children, outdoor workers, and asthma sufferers. According to EPA’s own analysis, every year in California alone, meeting the new standards would save more than 100 lives, eliminate 380 asthma emergency department visits, and prevent 120,000 lost school days.

The Clean Air Act requires EPA to set national ambient air quality standards for pollutants like ozone. These standards are periodically revised to make sure they adequately protect public health and welfare. Strong federal standards require areas with unsafe levels of air pollution to take active measures to address it, and can support efforts of states like California to do so. The Trump Administration previously attempted to delay the implementation of the 2015 ozone standards, only to relent in the face of lawsuits from Attorney General Becerra and others.
