Police arrested a 48-year-old felon on a murder charge after 52-year-old Timothy Tyrone Tyson was mistakenly shot and killed Jan. 29 outside a motel in the 2300 block of Philips Highway, according to the Jacksonville Sheriff’s Office.

Andre de Lane Burkes was also charged Wednesday with possession of a firearm by a felon after witnesses identified him, police said.

Multiple people saw the shooting, which began with an argument between Burkes and someone else at a Scottish Inn, Lt. Craig Waldrop said.

"He began shooting at that person, but instead hit that victim," Waldrop said. "... It was outside and inside. It started inside and carried to the outside."

Officers were dispatched about 4:45 p.m. and found Tyson lying in a rear parking lot next to a vehicle. Police said the two men did not know each other. Burkes has six prior arrests in Jacksonville, jail records show.
