Milwaukee mom who was smoking crack avoids prison in co-sleeping death of infant daughter

A mom who was high when she rolled over on her baby, killing the child, avoided prison at her sentencing Thursday for the co-sleeping death.

Wanda Pena, 29, was charged in February with second-degree reckless homicide for the death of her 4-month-old daughter Janeiris James. 

In September, Pena pleaded guilty to a reduced charge of second-degree recklessly endangering safety.

Milwaukee County Circuit Judge Jeffrey Wagner imposed but suspended a sentence of two years in prison followed by two years of extended supervision in favor of three years on probation.

One of the probation conditions is that Pena serve seven months at the House of Correction, with release for work, school and treatment. She must also get a mental health evaluation, comply with recommended treatment and remain sober.

According to the criminal complaint, emergency responders came to Pena's home in the 3500 block of West National Avenue about 2:30 a.m. Feb. 7 because Janeiris wasn't breathing. Pena eventually admitted to police she had smoked crack cocaine and marijuana before feeding the baby and falling asleep on top of her.

In 2015, first-responders were called to another address where Pena was living at the time after a 146-pound television fell on her 4-year-old son, Angel, killing him.
