Govt may next move to regularize Delhi’s 69 affluent colonies

The govt will address affluent colonies after completing the process for the lower-income group colonies

    New Delhi: A decision on granting ownership rights to residents of 69 affluent—but unregularized—colonies in Delhi, including Sainik Farms, Vasant Kunj and Chhatarpur, is likely to be taken after the Delhi assembly elections early next year.

    Last week’s decision by the Union cabinet on regularization of some of Delhi’s unauthorized colonies excluded these affluent neighbourhoods and those built on forest land.

    “We have a task at hand and will address these affluent colonies later, after we complete the process for the lower-income group colonies," a senior government official involved in the regularization process on condition of anonymity. “It is a time-consuming process and a tedious one. It will take around three months for the process to be completed for the lower income group colonies."

    Mint has reviewed the list of the 69 colonies (along with their registration numbers) that may be regularized later. Once they are regularized, residents will get ownership, mortgage and transfer rights.

    A total of 1,797 unauthorized colonies on public or private land have been constructed without any approved layout or building plans. About four million people live in such neighbourhoods, built over 43,000 acres. Ownership rights are currently transferred through a general power of attorney, will, agreement to sell and payment and possession documents.

    The central government will introduce a bill in the winter session of Parliament to provide for registration charge and stamp duty on the last transaction, as well as address the issue of income-tax liability on residents.

    The bill may be named after one of the late leaders of the Bharatiya Janata Party (BJP) such as former prime minister Atal Bihari Vajpayee, former finance minister Arun Jaitley, former external affairs minister Sushma Swaraj, and former Delhi chief ministers Madan Lal Khurana and Sahib Singh Verma.

    The rationale for the bill was to first benefit lower income groups, which live in these 1,797 colonies and then address the 69 affluent colonies.

    The regularization of the low-income neighbourhoods about three months ahead of assembly elections in Delhi is politically significant as these localities account for a sizeable voter base in Delhi. Their regularization has been a key campaign issue in Delhi, a promise made in the manifestos of both the ruling Aam Aadmi Party and the BJP, which rules at the Centre.

    Residents of these colonies will now get ownership and transfer rights to the land, as well as access to infrastructure and civic amenities. The rights will be conferred on payment of a nominal charge based on carpet area and plot size ranging from 0.5% to 2.5% of the circle rate.

    “For colonies on government land, the charge will be 0.5% (for less than 100 sq. m), 1% (for 100-250sq. m) and 2.5% (for greater than 250sq. m) of the circle rate of highest category of locality of the residential area surrounding the UC," the government said in a statement last week. “For colonies on private land, the charge will be half of the charge on government land."

    A committee under lieutenant governor of Delhi Anil Baijal was constituted on 8 March for recognizing ownership rights. Based on its recommendations, the ministry of housing and urban affairs circulated a draft cabinet note on 11 July, post which the matter was discussed on 30 July by a group of secretaries under Nripendra Misra, then principal secretary to Prime Minister Narendra Modi. Home minister Amit Shah then held a meeting on 18 August, which was followed by a meeting of a group of ministers and members of Parliament and other public representatives on 31 August. A revised cabinet note proposing draft regulations and ordinance was then prepared.

    For rights to be conferred, owners will have to apply on the Delhi Development Authority website, following which documents will be verified resulting in site verification. After that, GIS coordinates will be obtained and charges calculated. After all the formalities are completed, a conveyance deed will be issued.

    A sample profile based on a survey of 1,055 built-up and vacant plots in five unauthorized colonies located in A-block Amar Colony, Samaypur, Ranjeet Nagar, New Modern Shahdara and B-block Ayanagar was created.

    The new regulations will supersede 2008 regulations and 2007 guidelines.
