Delhi Court rejects Ratul Puri’s petition to cancel NBW

The court had said that his custodial interrogation was 'required for an effective investigation' as he was evasive in his replies during questioning

    NEW DELHI : A Delhi court on Wednesday dismissed Hindustan Powerprojects chairman Ratul Puri’s plea to cancel the non-bailable warrant (NBW) issued against him in a money laundering case related to the VVIP chopper controversy.

    “Considering the overall facts and circumstances, I do not find any ground for cancellation of NBW issued against accused Ratul Puri," special judge Arvind Kumar said while dismissing the application.

    “Accused had left the ED (enforcement directorate) office on 26 July without signing his statement. He has made himself unavailable and his whereabouts could not be ascertained," the court observed. The court also noted from the ED’s submission that there is a likelihood that Puri may tamper with evidence and influence witnesses. The order also observed that there have been several instances when Puri had not joined the probe despite repeated notices of the agency. Delhi high court on Tuesday had dismissed Puri’s application seeking anticipatory bail in the same case.

    The court had said that his custodial interrogation was “required for an effective investigation" as he was evasive in his replies during questioning by the investigating agency.

    Puri, in his application in Delhi high court had challenged the 6 August order of a special court that had dismissed his anticipatory bail application.

    He was arrested by the agency in a separate case related to a bank fraud and had approached the court saying there was no need for the NBW as he was willing to cooperate in the investigation.

    In January 2014, India had scrapped a contract with Finmeccanica’s British subsidiary, AgustaWestland, for supplying 12 AW-101 VVIP choppers to the Indian Air Force, over alleged breach of contractual obligations and charges of kickbacks worth 423 crore being paid to secure the deal. Puri was summoned by the ED after he was named by middlemen, Rajiv Saxena and Sushen Mohan Gupta, in the chopper scam.
