Three different traffic stops leads to three separate arrests for Fitchburg man

FITCHBURG — With several open firearms and drug charges, a city man was arrested once again last Thursday and charged with dealing crack cocaine and heroin, according to court and police documents.

Roberto A. Mojica, 22, of Congress Street, was spotted by police driving in the area of Wallace Road and River Street when the officer noticed that the car Mojica was driving had a defective rear light and an out-of-date inspection sticker, said police.

As a result, Mojica was pulled over and as soon as he was stopped, became argumentative telling the officer he had no right to stop him because he had already been stopped about the defective rear light.

While questioning Mojica, the officer noticed a backpack in the car’s backseat and asked him what was in it, and Mojica began arguing once again and then “lunged” toward the backseat to grab the backpack, said the officer.

The officer grabbed it first and during a search found a digital scale, and two plastic baggies, one containing a white power and another containing a brown powder.

After placing Mojica under arrest, the officer searched the car and found a brass knuckle.

Mojica was charged with possession to distribute a Class B controlled substance, possession to distribute a Class A substance, carrying a dangerous weapon, and cited for no inspection sticker and a lights violation, according to court documents.

When arraigned on Friday, bail that had been set for the other offenses was revoked and he was ordered held for 90 days, according to court documents.

In February, Mojica was stopped for an inspection sticker violation on Old Leominster Road and operating an unregistered motor vehicle. Before the car was towed, it was searched and found inside the trunk was was a handgun, according to court documents. Mojica was also carrying the ammunition for weapon.

As a result, he was charged with improper storage of a firearm, carrying a firearm without a license, possessing a firearm and ammunition without a FID card, and cited for a number plate violation, according to court documents.

He was released on a written promise to appear when arraigned on Feb. 14.

Then in March he was stopped once again for an inspection sticker violation and while being searched, an officer discovered five individually packages of crack cocaine and $220 in cash, according to court documents.

For that Mojica was cited with possession with intent to distribute a Class B controlled substance and ordered to appear in court on March 14, at which he was ordered held for 90 days for violating the conditions set after the firearms’ arraignment in February, according to court documents.

Mojica successfully objected to the bail revocation and on July 10, bail was set at $2,500 cash, which Mojica posted and he was released, according to court documents.

On Nov. 27, Mojica will be eligible for release, according to court documents.
