A Yeovil man who “point blank refused” to cooperate with the police after being arrested on suspicion of drink driving is to be sentenced next month.

Adrian Octavian Bocea was reported to the police after witnesses saw him driving erratically through Yeovil with visible damage to the vehicle.

When he was stopped and asked to take a roadside breath test he produced a positive result but then failed to provide a second required sample at the police station.

Bocea, 46, of Crofton Park, appeared in the dock at Somerset Magistrates' Court, sitting at Yeovil.

He pleaded guilty to a charge that on May 5 at Bridgwater police station when suspected of having driven a vehicle and required to provide a sample of breath for analysis, he failed to do so.

Prosecutor Emma Lenanton said that the defendant was witnessed to be driving in an erratic manner and there was visible damage to the vehicle.

“He was pulled over and failed a roadside breath test which and was then arrested and taken to the police station,” she said.

“However his failure to provide the sample at the police station has to be seen as deliberate.

“Bocea initially started the procedure but then said he would only provide a sample at the hospital.

“He was given a number of opportunities to comply and was warned about his behaviour a number of times, and in the officers words he point blank refused to provide a specimen and no medical reasons were identified.”

The magistrates said they would require a pre-sentence report to be prepared by the Probation Service before the case could be concluded.

They adjourned proceedings until June 21 when he will be sentenced and until then he was given unconditional bail and given an interim driving ban.
