Stayton man Joshua Nelson charged with aggravated murder after father found dead in driveway

A Stayton man is dead and his son is in custody on charges of aggravated murder following an incident Saturday.

Deputies were called to a home in the 41600 block of Stayton Scio Road, south of Stayton, on reports of an assault just before 10 p.m., according to a statement by the Linn County Sheriff's office.

Upon arrival, deputies found a person lying in the driveway and a second person running into the home.

Deputies say Robert Nelson identified the individual on the ground as his son, Timothy Dean Nelson, 50, and the man who ran into the home as his grandson, Joshua Elbert Nelson, 22.

Timothy Nelson was found to have died from injuries sustained in the incident.

Joshua Nelson barricaded himself in the home and refused to come out for about six hours before surrendering to police, according to officials.

He was arrested and charged with aggravated murder.

Officials are asking anyone who had saw Timothy Nelson or Joshua Nelson on Saturday to call Detective Colin Pyle at 541-967-3950.

Nelson was scheduled to appear in Linn County Circuit Court to be arraigned Monday afternoon.

The Linn County Sheriff's office was assisted by the Linn County Regional SWAT Team.
