Warrior pleads guilty to shooting Wichita Falls man in altercation over sister

A Wichita Falls man got probation Thursday after pleading guilty to shooting his sister's boyfriend during a fight that escalated from words, to fists, to cinder block to shotgun, court documents show. 

The men's dispute was over the woman, who had been arguing with her boyfriend, according to court records. A charge is still pending against the boyfriend in connection with the fight.

Aytch Eugene Warrior, 20, of Wichita Falls pleaded guilty Thursday in 89th District Court to aggravated assault, with a weapon, of a family member, according to court records. 

Judge Charles Barnard placed Warrior on 10 years of probation and fined him $1,500 in connection with the shooting of 25-year-old Bobby Charles Gaines of Wichita Falls, court documents show. 

The offense is punishable by up to life in prison.

Barnard put Warrior on deferred-adjudication probation because the judge found it in the best interest of society and the defendant, according to court documents.

If Warrior successfully serves out his probation, he can avoid having a conviction on his record. 

Gaines is charged with aggravated assault with a deadly weapon in connection with the incident, according to court records.

If convicted, he faces up to 20 years in prison. 

Gaines was free Thursday from Wichita County Jail on a $25,000 bond, according to jail records. 

A probable cause affidavit gave this account of the allegations against Warrior:

About 3:30 p.m. Nov. 11, 2019, police responded to a shots fired call in the 600 block of Roosevelt Street.

Gaines was arguing with his girlfriend at her home on Roosevelt Street while Warrior played video games in his room.

She was pregnant with Gaines' child, and he stayed at the home off and on. 

Warrior told police he heard them arguing. He knew Gaines had a history of domestic violence toward the woman. Gaines walked outside and continued arguing with her.

Warrior also walked outside and confronted Gaines. They agreed to fight each other. During the fight, Gaines picked up a cinder block and threw it at Warrior.

He got mad and retreated into the home. Warrior got a shotgun from his room and loaded it with a birdshot shell. He went back outside.

Gaines was standing on a curb across the street from Warrior. He fired the gun at Gaines, raining birdshot into his left side from hip to shoulder.

Gaines was transported to United Regional Health Care System. He had surgery to remove birdshot from his organs.
