A Jasper man is suing a podiatrist after he says several surgeries over two years on his ailing foot led to his leg being amputated.
Kolb says his foot problem stemmed from a back injury – that caused nerve damage to his leg.
He was referred to Dr. Pasquale Canceilliere, a podiatrist at the Indiana Foot and Ankle Clinic in Jasper.
After a series of setbacks and nine surgeries, Kolb says pain only became worse.
”I was in so much pain that I couldn’t get any relief and the only thing left to be done was to cut it off.”
Kolb is suing both the podiatrist and the clinic- who he says repeatedly misdiagnosed his medical conditions.
“I would like to get some money back from that and just some money for pain and suffering too because I have sure suffered a lot through this.”
“the most we can recover is a million 250. For this case we’re asking for all of it.” says attorney George Barnett.
But it won’t be easy.
“It’s a very complicated process to bring a medical malpractice case. First, you have to go in front of a panel of three doctors we’ve done that. The doctors have to decide whether not we have a case all three said we did.”
An attorney for “Indiana Foot and Ankle” gave us the opinion of a medical review panel as part of the Indiana Department of Insurance’s investigation.
The panel’s opinion is in two parts.
First, Dr. Canceilliere and the clinic both failed to comply with the appropriate standard of care, which factored into the resultant damages.
And second, the panel says there is no evidence to support claims regarding the hiring or oversight of the podiatrist.
Although it seems like an endless battle Kolb says he’s willing to fight for relief over something wishes he avoided.
