Cardiff council has issued a bus lane penalty from the same location where a fine was rejected by a national tribunal.

Samantha Cox received the ticket after mistakenly turning off the A4161 from Ely onto Cowbridge Road bus lane in Cardiff on February 2.

Ms Cox, 36, reported her error after she reportedly followed a white road sign marked Cowbridge Road East onto the wrong side of a traffic island.

But her appeal was rejected by Cardiff council one month after a motorist won a national tribunal relating to the same bus lane.

The Swansea doctor said: "As you approach the hatched area there are a couple of shops and off-road parking.

"I wanted to go down Cowbridge Road East by Victoria Park and I thought that was the way because of the road sign.

"I was on the wrong side of the traffic island but you have to continue down the bus lane."

The fine comes after Rob Williams, from Barry, received the same bus lane fine but won his case in a national traffic tribunal in January after Cardiff council rejected his appeal.

In a written adjudication it was found the white Cowbridge Road East road sign had to "potential to mislead or confuse".

Surface markings indicating the bus lane were also found to be "faded" and only visible after a vehicle has "already entered" the road.

But the white sign has now been removed, and signage now "complies with relevant legislation", Cardiff Council has said.

Ms Cox, from Cardiff, said: "I realised what I had done straight away. I had never been down the road before and just assumed that was the way to go.

"I wasn't trying to get away with it. I immediately phoned them but they said there was nothing I could do and I had to wait to see if a fine came through the post.

"The road situation was the same as when Mr Williams made his mistake. It's not as if I am a serial offender, the last time I had a bus lane fine was about four years ago."

Since April 1, 2018, 2,705 penalty notices have been issued to drivers illegally using the bus lane on Cowbridge Road East.

Ms Cox says she will take her case to the Traffic Penalty Tribunal.

A spokesman for Cardiff council said: "The council cannot comment on individual cases. If an appeal is received, it is judged on its merits in line with relevant legislation.

“As a matter of principle, the council does review all adjudicator decisions to see if any improvements are required or necessary. The location in question has the correct signage in place and complies with relevant legislation.

"The tribunal has not concluded in any cases that the restrictions at this particular location are unenforceable.

“To date, there have been 2,705 penalty notices issued to drivers, who have driven illegally in this bus lane since April 1 2018.”
