Columbus police officers have concluded their investigation into an accident on April 4 when a dump truck struck and killed a downtown pedestrian in a wheelchair, Lt. Lance Deaton said on Monday.

WD Feeney, a 30-year-old Columbus State University employee and graduate was killed as a result of the accident. Feeney used a wheelchair because he had cerebral palsy.

The dump truck was stopped at the red light. With Feeney’s wheelchair in front of the dump truck, the driver accelerated on the green light and hit the wheelchair, Deaton said. Feeney was pronounced dead at the Piedmont Columbus Regional Midtown campus as a result of the accident.

“He was not in the crosswalk legally,” Deaton said.

Feeney was on the west side of Broadway going north when he attempted to cross 11th Street in the crosswalk, Deaton said.

Feeney entered the crosswalk after the clear to walk signal on the pedestrian sign had changed to either a blinking red or don’t walk, Deaton said.

“We have reconstructed it and the driver couldn’t see him,” Deaton said.

The dump truck driver, Bradley Netherland, 62, of Phenix City, was cited for two traffic violations — an overweight truck crossing the Dillingham Street Bridge and stopping over the stop bar.

“He was not cited for anything related to the death,” Deaton said.

Fatalities are investigated by the Motor Squad. They reviewed surveillance video from nearby businesses, talked to a number of witnesses and performed several accident reconstructions. When the investigation concluded, police met with members of Feeney’s family on Friday. Monday morning they met with the truck driver and a representative from Joe Ryan Trucking, Deaton said.

There is one conclusion that can be drawn.

“The conclusion of this is it was just a tragic accident,” Deaton said.
